This past week, the U.S. Court of Appeals for the Third Circuit heard oral arguments in Curran v. Delaware.
Those challenging the Delaware MAID law could not establish standing at the District Court. But unlike parallel cases in the Second, Seventh, Ninth, and Tenth Circuits; this Court may reach beyond the standing issue to address the merits of whether the MAID statute complies with the ADA and the U.S. Constitution.
