As I have explained, for example in this University of Chicago video, clinicians across the country violate the dead donor rule every single day. These violations take at least four different forms. One of them is getting more attention.
The UDDA requires that brain death be determined according to accepted medical standards. Those are most probably the guidelines issued by the AAN. But a huge fraction of U.S. hospitals fail to determine BD/DNC in accordance with those guidelines.
Nevada, New York, New Jersey, and a few other states have statutes or regulations specifically requiring use of those guidelines. Now advocates in other states, like Kansas, are pushing for the same clarity.
