Despite Anthony's parents' objections, the hospital still planned to proceed with brain death testing. So, on April 17, 2026, the parents obtained a TRO prohibiting NUSM from administering brain death tests.
The parties will be back in court today (April 28, 2026) to argue whether N.Y. religious accommodation regulations require the hospital to delay testing. Apparently, the parents are not seeking complete abstention from testing. They just want a delay for 14 days or until May 1, 2026.
