The medical board of the southernmost state in Brazil, Rio Grande do Sul, has just issued a new guidance document on resolving medical futility conflicts in the ICU. These were apparently necessary to align with a new Patient Rights Statute enacted earlier this year.
Like other guidelines, it distinguishes physiological futility from evaluative judgments. In conflicts involving the latter, it recommends using a shared deliberative process and institutional mediation mechanisms like second medical opinions and bioethics committees.
