Almost all patients who have been the subject of medical futility / NBT / PIT conflicts have been unconscious or otherwise incapacitated. But in a recent French case, 60-year-old Remi personally objected to his Pitié Salpêtrière Hospital clinicians' June 2, 2026 decision to withdraw life-sustaining treatment on grounds of therapeutic obstinacy.
Nevertheless, on July 20, 2026, the Council of State agreed that clinicians could proceed as they deemed appropriate. Both the court and clinicians may be emboldened after the European Court of Human Rights upheld the French procedure for resolving these conflicts in Medmoune.
The Pitié-Salpêtrière Hospital is one of the most significant in Paris. It where Princess Diana was taken after her fatal car crash in August 1997.
