95-year-old Tiem Thi Nguyen had dementia, kidney disease, and other illnesses. She also had a POLST indicating DNR. But when she stopped breathing at her Portland, Oregon SNF, staff performed CPR. That fractured her ribs and punctured her lungs. Nguyen lived another 7 days with significant suffering.
In July 2026, Nguyen's children sued Marquis Companies which runs Marquis Piedmont Post Acute Rehab. The family alleges negligence and NIED. (Multnomah County Circuit Court No. 26-CV-35252).
This is the latest in a growing line of verdicts and settlements against clinicians and entities for violating advance directives and POLSTs.
