Contrast the ongoing court case of Ailin Marat Gabdullina. She choked on a banana on June 8, 2026. After some delays, Rady Children's administered both tests and determined her dead on June 25, 2026.
Normally, families have few grounds to challenge hospitals after BD/DNC. But Ailin's parents (Russian Muslims) filed multiple lawsuits in Orange County Superior Court, seeking TROs and preliminary injunctions. First, they allege that Rady committed battery and other torts by conducting brain death testing without consent. Second, they allege religious objections to brain death. Third, they seek more time to review records and seek transfer. A hearing is scheduled for July 15, 2026.
