After months of media scrutiny and congressional hearings about erroneous death determinations, we have seen numerous reports about individuals de-registering as organ donors. Now, it seems some estate planning lawyers may warn their clients about how to complete advance directives and other planning documents.
Here is one comment from the October 2025 Tennessee Bar Journal: "Some of my clients tell me, 'Of course, I want to be organ donor.' Others are concerned that unscrupulous actors lead to attempts to harvest organs too soon. I used to think such concerns were the province of conspiracy theories, but recently I’ve seen stories of sometimes rushed medical determinations ..."
