Most 2025 legislation on medical aid in dying (MAID) focuses on authorizing it for the first time (e.g., in Delaware, New York). But most of the eleven states that already have MAID legislation have been moving to amend it to improve access.
Most amendments focus on:
1. Expanding attending and consulting clinicians from physicians to APRNs or PAs.
2. Expanding the types of licensees who can be mental health clinicians
3. Reducing waiting periods or permitting them to be waived
4. Eliminating state residency requirements
5. Mandating policy transparency
Other recent amendments have not been pursued in 2025:
1. Permitting intravenous administration
2. Permitting access for patients with dementia
3. Permitting advance directives for MAID
But Oregon is pursuing new types of amendments:
1. Expanding who can witness a written request
2. Changing the definition of "terminal illness"
3. Reducing the role of the consulting clinician
