Upon taking office, President Biden reversed a number of Trump executive orders and halted the publication of several sets of regulations from the HHS Office of Civil Rights. But President Boden did not reverse President Trump's September 2020 Executive Order 13952: Protecting Vulnerable Newborn and Infant Children.
EO 13952 restricts physicians' ability to withhold therapies from extremely premature newborns. "Every infant born alive, no matter the circumstances of his or her birth, has the same dignity and the same rights as every other individual and is entitled to the same protections under Federal law.”
Now, pediatricians are calling on President Biden to reverse this executive order. They argue that the law unduly restricts the ability of families and physicians to consider quality of life in decision-making about infant care. Even when physicians have no medical treatment to offer babies born before 24 weeks, EO 13952 could compel them to intervene in an effort to keep their hearts beating.
