Texas Court Orders Hospital to "Treat" Dead Girl Payton Summons

Last Tuesday, 9-year-old Payton Summons suffered a cardiac arrest and was unconscious when she arrived at Cook Children's Medical Center in Forth Worth, Texas. Sadly, clinicians soon determined that Payton was dead.

 Nevertheless, Payton's parents would not accept that diagnosis. Yesterday, their attorney got a temporary restraining order that prevents the hospital from removing organ support for 14 days. (HT Dallas News)

 The parent's attorney apparently asserted rights under the Texas Advance Directives Act. But as the Texas courts confirmed in the infamous Marlise Munoz case, TADA does not apply when the patient is dead.

    Thank you for following this case. So tragic and sad. Unclear if the second exam has been done. Also according to even the mother she has a large tumor around the heart. So a very complicated case more so then others.
